HIV and the Law
I am currently researching for a community legal centre that is making submissions to the Western Australian Equal Opportunity Commission. It is hoped that the submissions will lead to legislative amednments to include or re-define anti-discriminatory laws in Western Australia.
My topic is on public acts that vilify or express hatred of or contempt for those infected or believed to be infected with HIV. It is currently not a specific ground in Western Australia.
I am interested from an international perspective of any laws that anyone knows about in their country about anti - discriminatory laws that target specifically on HIV and other blood borne viruses.
If you could post them on this forum, that would be great.

actually I have no idea about Indonesian Law about anti discriminatory in HIV and blood borne virus.
because of there`s no law, sometimes, the employer fired the employee. Even if the possibility for the work to spread the infection is very small.
So, here, it tends to hide the fact that someone might be infected with those virus. Because, like you said, other people might express their hatred to the infected person. But, it also made the infection could be spread widely.
I really would like to hear more about it.

I did a quick search for Danish laws mentioning HIV, but the only hit I got was one stating that it is illegal to practise unsafe sex for people diagnosed with HIV, unless they have explicitly informed their partner of their diagnosis. Offenders face up to 8 years imprisonment.
I am not sure whether HIV-infected persons would be protected by the general anti-discriminatory legislation. In the statement of the scope of the laws, the closest match is "handicap", but is HIV considered a handicap? The examples I have found all deal with physical handicaps.

In South Africa we have very strong anti-discrimination laws in our new constitution due to our past laws. So you can not discriminate against someone with HIV. It is a big thing in South Africa along with there right to medication as Aids is very high in our country
